dClimate Siren – Privacy Policy

At dClimate Inc., we take privacy and security concerns seriously. This Privacy Policy outlines how dClimate Inc. and its affiliates (collectively, “dClimate”) process the information we collect through our websites, mobile apps, and other services we provide to you (collectively, “Services”).

I. Types of Data Collected

We may collect the following information from communications generated when you sign up for an account, request a transaction, enroll in a promotion or program, or otherwise use our Services:

Identity Data. Identity Data may include your full name and contact information. We do not intend to request or store more detailed Personal Identifiable Information (PII) such as your date of birth, gender, social security number, and other data on government-issued identification documents, and other PII information.
Contact Data. Contact Data includes your email address, mailing address, and telephone number.
Financial Data. Financial Data includes your bank account, wallet, payment card details, and other information necessary for “know your customer” and anti-money-laundering laws and regulations including, potentially, account balances, financial transaction history, credit history, and tax information.
Profile Data. Profile Data includes your username and password, purchases or orders made by you, your knowledge assessment results, and your interests, preferences, feedback, and survey responses.
Usage Data. Usage Data includes information about how you access and use our Services, such as the pages and features you use, links and buttons you select, session duration, referring pages, URLs, and other interactions with the Services. It may also include photos, media, and other content you choose to provide. We only access your device camera roll and camera with your permission. You can update those permissions in your device settings.
Analytics and Session Replay Data. If you enable Analytics in our cookie preferences, we use Datadog Real User Monitoring (“Datadog RUM”) to collect technical information about your use of Siren. This may include an anonymous session identifier, browser, operating system and device information, approximate location derived from your IP address, page-load and resource performance, frontend errors, network request information, and user interactions. A sample of consented sessions may be reconstructed as a session replay so that we can identify usability problems and understand where users encounter friction.

Siren configures Session Replay to mask page text, form input, images, links, data attributes, and interaction labels. We do not intentionally provide Datadog with your name, email address, password, payment information, or Siren account identity through RUM. URLs, resource names, and error details may nevertheless be included in technical telemetry.
Additional Data. Additional Data includes information that you submit via focus groups, contests/sweepstakes, job applications, customer support, and other similar means. We may also collect any communications between dClimate and you (including recording calls made to or by dClimate) and any other information you provide to dClimate.

II. How We Use the Data We Collect

We use and process the data we collect for purposes described in this Privacy Policy or as otherwise described to you through our Service or in connection with our Services. For example, we use the data to:

Create and process your account and deliver the Services to you, including to allow you to register for the Services and participate in interactive features and for dClimate to authenticate your identity, handle billing and account management, fulfill our legal and regulatory obligations, and complete other administrative matters.
Send you transactional information, including confirmations, invoices, technical notices, product and services information and announcements, software updates, security alerts, support and administrative messages, and information about your transaction with us.
Communicate with you to respond to your comments and questions, deliver newsletter or other content we believe you will be interested in, provide customer service or feedback, contact you about amounts owed, conduct surveys, respond to employment opportunities for which you’ve applied, notify you about upcoming events, or for any other purposes in connection with the Services.
Conduct research and analytics to better understand our visitors and customers and tailor our product offerings. Where you consent to Analytics, this includes using Datadog RUM and masked Session Replay to measure performance, diagnose errors, and identify usability friction.
Provide you with updates about products and services offered by us and our selected partners, as well as to facilitate new contests, sweepstakes, promotions, and rewards.
Make suggestions and recommendations to you about things that are similar to those about which you have inquired or that may otherwise be of interest to you, such as providing you with advertisements based on your interests and activity on the Services.
Monitor, administer, and enhance our Services, including troubleshooting, data analysis, testing, research, statistical, and survey purposes. We do not use Datadog RUM or Session Replay for advertising or to make decisions that produce legal or similarly significant effects about you.
Ensure and enhance the safety and security of our Services, business, and users, and investigate or provide notice of fraud or unlawful or criminal activity.
Perform audits and protect or exercise our legal rights or defend against legal claims, including to enforce and carry out contracts and agreements.
Comply with applicable laws and legal obligations.

III. When We Share Data

dClimate is committed to maintaining your trust, and we want you to understand when and with whom we may share the data we collect.

dClimate affiliates. We may share personal data with other companies owned by, controlled by, or affiliated with dClimate. These companies are permitted to use your personal information in the same way that dClimate does under the Privacy Policy.
Datadog, Inc. If you enable Analytics, Datadog processes RUM and masked Session Replay data on our behalf so that we can measure application performance, troubleshoot errors, and improve usability. Datadog acts as our service provider or data processor and may engage subprocessors to provide its services. We do not sell this information to Datadog or permit Datadog to use it for advertising. Legal purposes. We may disclose personal data to respond to subpoenas, court orders, legal process, law-enforcement requests, legal claims, or government inquiries and to protect and defend the rights, interests, safety, and security of dClimate, our affiliates, users, or the public.
With your consent. We may share personal data for any other purposes disclosed to you with your consent. We may also share information with others in an aggregated or otherwise anonymized form that does not reasonably identify you directly as an individual.
Stripe, Inc. By using the services provided by dClimate, you acknowledge and consent to our use of Stripe, Inc. (“Stripe”) as our third-party payment processor. In order to facilitate payments and provide a seamless transaction experience, it is necessary for dClimate to share certain personal and financial information with Stripe. This may include, but is not limited to, your name, credit card information, billing address, and transaction amounts. dClimate has chosen Stripe due to its robust security measures and commitment to protecting your financial data. However, it is important for you to understand that your payment information will be processed by Stripe in accordance with its privacy policy and security standards. We encourage you to review Stripe’s privacy policy to fully understand how your personal information will be handled.

Your consent to the sharing of your data with Stripe will be mandatory for the completion of transactions with dClimate. Without this consent, we will not be able to process your payments through our platform. By proceeding with your transaction, you are explicitly agreeing to the use of your data by Stripe for payment processing purposes.

IV. Cookies, Third-Party Tracking, and Online Advertising

Our Services use cookies and similar browser storage. Some are necessary for authentication and core functionality. Analytics storage is optional and is used only after you enable Analytics in our cookie preferences. Rejecting Analytics does not prevent you from using Siren’s core functionality.

Datadog RUM cookies and storage

Siren_Cookie_Consent_v2: local browser storage that records your analytics preference. It remains until you change the preference or clear the site’s browser storage.
_dd_s_v2: a first-party Datadog cookie that groups events into a session and maintains an anonymous identifier. It may remain for up to one year. An active RUM session expires after 15 minutes of inactivity and cannot exceed four hours.
dd_cookie_test_* and dd_site_test_*: temporary cookies used to determine whether the browser supports cookies. They expire immediately.

Datadog’s RUM cookies are set on the Siren domain and are not used for cross-site advertising or tracking. If you reject Analytics, Siren instructs Datadog not to collect your activity or session experience.

Analytics retention

Datadog ordinarily retains sessions, page views, actions, errors, and session recordings for up to 30 days. Resource-performance and long-task events are ordinarily retained for up to 15 days. We may delete data sooner when it is no longer needed, and we will update this Policy before materially extending these periods for Siren RUM data.

V. Control Over Your Information

You can accept or reject Analytics when the cookie preference dialog is displayed. You can withdraw your consent at any time without affecting the lawfulness of processing that occurred before withdrawal. Withdrawing consent stops future Datadog RUM and Session Replay collection on that browser.

The information you provide to us through your account profile can also be changed or deleted by logging into your account.

You may also email us at privacy@dclimate.net to request that we delete certain personal information about you. We may verify the request by asking you to provide information that matches information we have on file about you. You can also designate an authorized agent to exercise these rights on your behalf, but we will require proof that the person is authorized to act on your behalf, and we may also still ask you to verify your identity with us directly.

VI. International Data Transfers

Siren’s Datadog account uses Datadog’s United States site. If you enable Analytics, RUM and Session Replay data may therefore be transferred to and processed in the United States and in other countries where Datadog or its authorized subprocessors operate. Where required, we rely on appropriate safeguards for these transfers, including Datadog’s Data Processing Addendum and applicable Standard Contractual Clauses.

VII. Notices to Certain Users

A. California Users

Under California Civil Code Section 1798.100 (California Consumer Privacy Act), California residents may have certain data protection rights regarding their personal information. These rights include the right to disclosure, deletion, access, and nondiscrimination, as well as the right to opt out of having your personal information shared or sold. To exercise your rights under the California Consumer Privacy Act, please email us at privacy@dclimate.net as described in section V.

The following are categories of personal information defined under the California Consumer Privacy Act that we may collect, receive, or maintain in the course of administering the Services: Identifiers, Personal information described in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)), Protected classification characteristics under California or federal law, Commercial information, Biometric information, Internet or other electronic network activity, Geolocation data, Sensory data, Professional or employment-related information, Non-public education information, and inferences drawn from other personal information.

B. European Union and United Kingdom Users

Under EU and UK data protection laws (UK GDPR/2018 Data Protection Act and EU GDPR), individuals may have certain data protection rights regarding their personal information. These rights include the right to request access to, rectification of, or erasure of your personal information, as well as the right to ask us to restrict the processing of your personal information. You may also have a right to object to processing of your personal information where it is carried out for our legitimate interests or direct marketing. We rely on your consent to use Datadog RUM and Session Replay, and you may withdraw that consent at any time as described in section V. Individuals may also have a right to lodge a complaint about the processing of their Personal Information with their local data protection authority.

VIII. Changes to this Policy

This Privacy Policy may evolve with time. If we update it, we will revise the date listed in the heading and post the new version. To stay informed of our privacy practices, we recommend you review the Privacy Policy on a regular basis as you continue to use our Services.
